Supreme Court Delivers a Blow to DIY Gun Builders


Ghost Guns


The digital ink had barely dried on predictions of unwavering support for the Second Amendment from the Supreme Court when a curveball decision dropped. In Bondi v. VanDerStok, the Court upheld a controversial 2022 ATF rule targeting so-called "ghost gun" kits. In a 6 to 3 decision, SCOTUS sided with the Biden administration, backing the agency's authority to regulate and serialize unfinished firearm parts like 80% lowers - parts that, until now, lived in a legal gray zone.

This is a significant shift in the regulatory landscape. For years, gun enthusiasts could legally buy kits containing unfinished receivers and build functional firearms at home - no serial number, no background check, no federal paperwork. It wasn't just about hobby building; for many, it was a matter of privacy, principle, and a perfectly legal exercise of their rights.

But the ATF's 2022 rule changed the game. It reclassified these parts - specifically those that could easily be converted into working firearms - as actual firearms under federal law. That meant new requirements: serialization, background checks, and purchases only through licensed dealers.

To gun control advocates, this was a long-overdue fix to a dangerous loophole. To gun owners, it was executive overreach in its purest form - an unelected agency effectively rewriting the law.

Second Amendment groups quickly challenged the rule, arguing the ATF had no legal authority to redefine what is - or isn't - a firearm. An unfinished hunk of aluminum or polymer, they said, is not a firearm. Not until it's machined, drilled, and assembled. Anything less was an abuse of power and a clear encroachment on personal freedom.

But the Supreme Court didn't see it that way.

In a ruling that stunned many in the gun community, especially after the Court's pro-2A stance in Bruen, the justices allowed the ATF's rule to stand. The majority opinion gave wide latitude to the government's ability to regulate components based on their intended use and ease of conversion.

Bottom line: The days of anonymous, untraceable gun kits are effectively over. If you plan to build a firearm at home, expect to follow the same rules as if you were buying one off the shelf - or risk federal charges.

What This Means Going Forward

This ruling sends shockwaves beyond just the ghost gun market:

  • It kills the gray market for 80% lowers and DIY kits, making casual home builds a legal minefield.


  • It expands the ATF's regulatory power, setting a precedent that could be used to target other parts and accessories down the line.


  • It exposes a crack in what many thought was a solidly pro-gun Supreme Court.

  • That last point can't be overstated. After Bruen established the "history and tradition" test for evaluating gun laws, many expected a high bar for any new regulation to clear. Instead, the Court signaled it's willing to weigh public safety concerns against Second Amendment protections - especially when the firearms in question bypass traditional safeguards like background checks and serialization.
