House Republican Pushes Bathroom Ban Targeting First Transgender Member of Congress
Republican Rep. Nancy Mace of South Carolina has introduced legislation that would ban transgender individuals from using bathrooms on Capitol Hill that align with their gender identity. The proposed legislation directly impacts Sarah McBride, a Democrat from Delaware who will become the first openly transgender member of Congress when sworn in this January.
The brief bill, introduced by Mace on Monday, states:
"A Member, Delegate, Resident, officer, or employee of the House may not use a single-sex facility (including a restroom, changing room or locker room) in the Capitol or House Office Buildings, other than those corresponding to the biological sex of such individual."
The enforcement of this prohibition would fall under the responsibility of the Sergeant-at-Arms.
"Biological men do not belong in private women's spaces. Period. Full stop. End of story," Mace declared in a statement on X (formerly Twitter).
Justification and Criticism
Mace argues that the ban is necessary, claiming that permitting "biological males into single-sex facilities" jeopardizes the safety and dignity of women in the Capitol. She further stated that her legislation is about protecting "real women and women's rights," accusing the "far-left" of seeking to "erase" those rights.
Critics, however, contend that the bill lacks empirical support. Studies have repeatedly shown no evidence that allowing transgender individuals to use facilities aligned with their gender identity increases safety risks. The move has been widely condemned as an unnecessary escalation in the ongoing culture war.
In response to online accusations that the bill specifically targets McBride, Mace confirmed, "Yes and then some." She added, "Sarah McBride doesn't get a say here. I will always protect women and girls."
McBride Responds
Sarah McBride responded to the proposed legislation with a statement on X, calling it a "blatant attempt from far right-wing extremists to distract from the fact that they have no real solutions to what Americans are facing."
"We should be focused on bringing down the cost of housing, health care, and child care, not manufacturing culture wars," McBride wrote. "Delawareans sent me here to make the American dream more affordable and accessible, and that's what I'm focused on."
Enforcement Questions Remain
When asked how the rule would be enforced, Mace did not provide specific details, reiterating instead her belief that "biological men shouldn't be in women's private spaces. End of story."
The introduction of this bill underscores the continued polarization surrounding transgender rights in the United States, particularly as more transgender individuals gain visibility in public office.
